Please read these Terms of Use (“Terms”) carefully before using the website located at www.projectkinship.org (the “Site”), operated by Project Kinship, a California nonprofit corporation [and 501(c)(3) tax-exempt organization, EIN: [XX-XXXXXXX] (“Project Kinship,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, please do not use the Site.

1. Acceptance of Terms



These Terms constitute a legally binding agreement between you and Project Kinship governing your access to and use of the Site, including any content, functionality, and services offered on or through the Site. Your continued use of the Site after any changes to these Terms constitutes your acceptance of those changes.

2. About the Site



The Site is provided to share information about Project Kinship’s mission, programs, and services supporting individuals affected by the justice system in Orange County and surrounding communities; to facilitate communication with our organization; to enable individuals to sign up for our newsletter or mailing list; and to direct visitors who wish to make a donation to our designated third-party donation processing platform. The Site is not itself a substitute for, and does not constitute, enrollment in or delivery of any Project Kinship program or service.

3. Eligibility and Accounts



The Site is intended for general audiences and does not knowingly collect information from children (see Section 7 of our Privacy Policy). The Site does not currently require you to create an account to browse content, sign up for our newsletter, or contact us. If account functionality is added in the future, you are responsible for maintaining the confidentiality of any login credentials and for all activity that occurs under your account.

4. Intellectual Property



All content on the Site — including text, graphics, logos, images, video, audio, and the compilation and design thereof — is owned by Project Kinship or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws, unless otherwise noted. You may view, download, and print content from the Site for your own personal, noncommercial, and informational use, provided you do not remove or alter any copyright, trademark, or other proprietary notices. Any other use of Site content — including reproduction, modification, distribution, republication, or creation of derivative works — without our prior written consent is prohibited.

The Project Kinship name and logo are trademarks of Project Kinship. Nothing in these Terms grants you any right to use our name, logo, or other trademarks without our prior written permission.

5. Acceptable Use



When using the Site, you agree that you will not:

  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to the Site, its servers, or any connected network or system;
  • Introduce viruses, malware, or other harmful code, or otherwise interfere with the Site’s functionality or security;
  • Use any automated system (bots, scrapers, spiders, etc.) to access the Site without our prior written permission;
  • Submit false, misleading, abusive, threatening, or unlawful content through any form, comment field, or contact mechanism on the Site;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity; or
  • Collect or harvest personal information about other users of the Site.


6. User Submissions



If you submit information to us through a contact form, newsletter sign-up, or similar feature (“Submissions”), you represent that the information you provide is accurate and that you have the right to submit it. You grant Project Kinship a nonexclusive, royalty-free right to use Submissions solely for the purpose for which they were submitted (for example, responding to your inquiry or sending you newsletter communications you requested). Please do not submit confidential, sensitive, or privileged information through general Site forms. See our Privacy Policy for details on how Submissions and other personal information are handled.

7. Donations and Third-Party Services



Project Kinship does not process donations or payments directly on the Site. Where the Site provides a link or embedded widget to make a donation, you will be directed to or interact with a third-party donation processing platform (currently [DONATION PLATFORM NAME, e.g., “Classy,” “Donorbox,” etc.]), which operates under its own terms of use and privacy policy. Project Kinship is not responsible for the availability, content, security practices, or performance of any third-party donation platform, and any information you provide to process a donation (such as payment card information) is collected and handled by that third party, not by Project Kinship. We encourage you to review the applicable third party’s terms and privacy policy before making a donation.

8. Third-Party Links



The Site may contain links to third-party websites or resources, including social media platforms and partner or funder websites. These links are provided for your convenience only. Project Kinship does not endorse and is not responsible for the content, accuracy, or practices of any linked third-party site. Your use of any third-party site is at your own risk and subject to that site’s own terms and policies.

9. No Professional Advice; Not a Substitute for Services



Content on the Site — including program descriptions, resource lists, blog posts, or informational materials — is provided for general informational purposes only and does not constitute legal, medical, mental health, financial, or other professional advice. It is not a substitute for individualized guidance from a qualified professional, nor is it a substitute for direct engagement with Project Kinship’s programs and case management staff. If you are seeking services, please contact us directly through the methods described on the Site.

THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS PROVIDED ON OR THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. PROJECT KINSHIP DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT ON THE SITE.

11. Limitation of Liability



TO THE FULLEST EXTENT PERMITTED BY LAW, PROJECT KINSHIP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, EVEN IF PROJECT KINSHIP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification



You agree to indemnify, defend, and hold harmless Project Kinship and its officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site or your violation of these Terms.

We may update, modify, or discontinue the Site, or any part of it, at any time without notice. We may also revise these Terms from time to time. The “Effective Date” at the top of this page indicates when these Terms were last revised. Your continued use of the Site after any revision becomes effective constitutes your acceptance of the revised Terms.

14. Governing Law



These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.

15. Severability; Entire Agreement



If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Project Kinship regarding use of the Site.
